GENERAL TERMS AND CONDITIONS OF SALE

These General Terms and Conditions (the “General Conditions”) govern the offer and sale of the products available on the website “ameticshop.com” (the “Site”).

Users are invited to read these terms carefully before placing any order: submitting an order for any of our products implies full acceptance of these conditions.

The products available for purchase through ametìcshop.com are sold by MarEthica S.r.l. (also the “Seller” or “we”), with registered office in L. Maremonti 10, 73100 Lecce (Italy), registered with the Companies Register of Lecce, VAT number 05411170755, share capital Euro 10,000.00.

1. General Provisions

These General Terms and Conditions apply to all services provided by the Seller and govern the purchase of the products offered (the “Products”) through the Site.

For the purposes of these general conditions, “Customer” means any natural person over 18 years of age, having the capacity to act, and purchasing goods for purposes unrelated to any business, commercial, artisanal, or professional activity.

If the user does not qualify as a Consumer, they are invited to contact Ameticshop customer service beforehand. MarEthica may decide not to process orders issued by subjects not definable as end consumers or otherwise not consistent with its commercial policies, particularly orders from entities qualifying as companies.

The offer and sale of Products through the Site is available exclusively for the countries listed in the relevant section accessible from the Site homepage.

The Seller reserves the right not to proceed with orders that do not comply with its commercial policy.

These General Terms and Conditions of Sale govern the proposal, submission, and acceptance of purchase orders of products orderable via the Site, between users of ameticshop.com and the Seller.

The Seller may amend these General Terms and Conditions of Sale. It is understood that any changes will not affect orders already completed. New provisions take effect upon publication on the Site. Users are therefore recommended to regularly check the Site for the updated version.

The conditions applicable to the order are those in force at the time the order is placed by the Customer.


2. Conclusion of the Contract with the Seller

The contract is concluded in Italy between the Customer and MarEthica S.r.l.

To place an order and purchase one or more Products on ameticshop.com, the Customer must complete the online order form and submit it electronically to the Seller, following the instructions on the Site. The purchase proposal is formulated by the Customer when sending the electronic order form.

The order form contains essential information on each selected product, including name, unit price, available payment methods, terms and shipping costs, and any additional charges.

The contract is considered completed upon payment by the customer and only upon the acceptance and subsequent receipt by the Customer of a confirmation email from the Seller, which attests to the receipt and acceptance of the order after verifying the accuracy and completeness of the data provided. It is recommended to keep this email as proof of purchase.

The Seller will retain the order form for the time strictly necessary to manage the order, in accordance with applicable law.

The Customer will receive the invoice by filling in the appropriate fields in the billing address section. The invoice will be sent via email following order processing.

Contracts with the Seller may be concluded in Italian or English.

All orders are subject to acceptance by the Seller. The Seller reserves the right not to process orders that do not provide sufficient solvency guarantees, are incomplete or incorrect, or if products are unavailable.

In case of unavailability, the Customer will be informed promptly – within fourteen (14) days of receiving the order. If payment has already occurred, the Seller will fully refund the amount paid.

The Seller may also refuse orders in case of obvious pricing errors, suspected fraudulent activity, or non-compliance with the general terms of sale.


3. Warranties and Intellectual Property Rights

MarEthica guarantees the authenticity of all products purchased on the Site. Products sold on ameticshop.com come exclusively from carefully selected artisans.

Essential characteristics of each product are described on the respective product pages. However, images and colors may differ slightly from the real product due to: the customer's device settings; the handcrafted nature of the product.

Customers enjoy the legal guarantees provided by applicable law, including conformity of the product to the sales contract. In case of manufacturing defects, contact customer service at info@ameticshop.com.

All products are covered by a 24-month legal warranty against non-conformity defects (as required by EU law). The defect must be reported within two (2) months of discovery. The warranty includes the right to repair or replacement, free of charge, or—if these are not possible—a price reduction or contract termination. After 26 months from delivery, the right to claim expires unless fraud by the Seller is proven.

If the Customer requests repair or replacement, all shipping costs—including return and re-delivery—are borne by the Seller.

The return procedure follows the same methods described in clause 6 unless otherwise indicated.

All content on the Site – including, by way of example, works, texts, sounds, videos, images, photographs, dialogues, documents, drawings, logos, trademarks, and any other material in any format – is protected by copyright and other intellectual property rights of the Seller or the respective owners. Any form of reproduction, modification, duplication, copying, distribution, sale, or other use of the content and images on the Site is prohibited without the prior written authorization of the Seller.

All distinctive signs relating to the products and services on the Site are registered trademarks of their respective owners and are used by the Seller, as owner and/or authorized licensee, exclusively to identify, describe, and promote the products and services offered on the Site.

Any use of the aforementioned distinctive signs that does not comply with the law or is unauthorized is prohibited. It is also prohibited to use the distinctive signs on the Website to obtain an undue advantage from their notoriety or in any way that could prejudice the signs themselves or their owners.


4. Prices

Product prices are expressed in Euro and do not include shipping costs.

The applicable price is that shown at the time of order submission.

The Seller may modify prices at any time, but orders already placed will reference the price at the moment of confirmation, except for obvious errors.

Prices in the Italian version of the Site apply only to purchases made in Italy; prices in the English version apply to purchases outside Italy.


5. Payment Methods

Payment for the price of the products, as well as shipping and delivery costs, must be made using one of the payment methods indicated on the order form.

In the case of payment by credit or debit card, sensitive data (such as card number and expiration date) will be transmitted securely via encrypted protocol to Stripe, or to other banking institutions responsible for managing electronic payments, without the possibility of access by third parties. The Seller will use this data exclusively to complete the purchase process, manage any refunds in the event of a return or exercise of the right of withdrawal, or to report suspected fraud to the competent authorities. The amount corresponding to the order, including any additional costs, will be charged at the time of order confirmation.

In the case of payment by bank transfer, the order will be considered valid and confirmed only upon receipt of the actual credit by the Seller.

Credit cards will be subject to verification and authorization by the issuing institution. MarEthica will not be responsible for any failure to obtain authorization from the institution in question. Once the contract has been concluded in accordance with Article 2.5 above, the charge to the credit card will be final.


6. Shipping and Delivery

The purchased products will be delivered to the address indicated on the order form, according to the terms and conditions of the delivery service chosen by the customer.

For each order, the Seller will issue a receipt or invoice, sent by email or post, in accordance with current legislation. The information contained in the tax document will be that provided by the Customer at the time of ordering and will not be subject to change after issuance.

Shipping costs are charged to the Customer and will be indicated on the order form and in the relevant tax documentation.

Shipping costs will be calculated for each order, based on the country of destination of the product or products ordered and the weight of the package shipped. The customer can check the status of the delivery using the tracking code that will be sent by email by the courier.

Products are only shipped to certain countries, namely those indicated at checkout and selectable in the delivery address form.

The Seller is not responsible for delays or non-delivery of products by the courier. From the moment the courier picks up the products ordered by customers, all responsibility for the delivery of these products lies exclusively with the courier. The Seller is not responsible for loss, theft, or damage that occurs during shipping.

Orders shipped to countries outside the EU may be subject to customs duties and local taxes, determined by the competent authorities of the destination country. The Customer accepts that if delivery is made abroad, customs duties and import taxes will be charged to them and that, as the importer, they must comply with the import laws of the relevant country.

The Products will be delivered by a courier selected by the Seller on working days (excluding Saturdays, Sundays, and public holidays), based on the times indicated on the product page. As these are handmade products made to order, shipping will follow the production times of the product.

Delivery is considered complete when the product is made available to the Customer at the address indicated in the order.

Upon delivery, the Customer (or a representative) must verify: that the number of products corresponds to that indicated in the transport document; that the packaging and seals are intact.

Any anomalies (damage, missing items, errors) must be immediately reported in writing on the courier's delivery document. In the absence of any notes, no complaints regarding the external appearance of the packages received will be accepted.

The Customer is required to promptly verify that the products delivered are correct and complete. Any discrepancies (e.g., incorrect, missing, or damaged goods) must be reported, without prejudice to the provisions of Article 3, within 2 working days of receipt of the order, providing appropriate documentation. After this period, the order will be considered definitively accepted. Any communications must include proof of the discrepancies complained of.


7. Right of Withdrawal

The Customer has the right to withdraw from the contract concluded with the Seller in relation to products purchased from ameticshop.com, without penalty and without specifying the reason, by notifying the Seller within 14 (fourteen) days from the date of receipt of the products purchased under these general terms and conditions.

Withdrawal must be exercised within the period referred to in the previous paragraph, by returning the products purchased, after activating the return procedure by contacting the Seller via email at info@ameticshop.com.

It is an essential condition for the customer to exercise the right of withdrawal that the integrity of the products to be returned is preserved. In particular, the products must not have been used or damaged. Furthermore, the products: must be returned in their original packaging, which is an integral part of the Products; must be returned to the Seller within fourteen (14) calendar days from the date of notification of withdrawal.

Pursuant to Article 59 of the Consumer Code, the right of withdrawal, cancellation, or return—normally granted to the customer—is excluded for orders relating to personalized or customized products.

Most of the items available on the Website are made specifically for the Customer after the order has been confirmed. No returns or exchanges are allowed for these products, except for the exceptions specifically indicated in the relevant product description. Both personalized items and items made to order are considered final sales.

The costs of returning the product are borne by the customer.


8. Refunds

If the withdrawal is exercised correctly, the Seller will refund the amount paid using the same payment method.

If the withdrawal is not validly exercised, no refund is due.


9. Applicable Law and Jurisdiction

These general terms and conditions of sale are governed by Italian law and, in particular, by Legislative Decree No. 206 of September 6, 2005 (the so-called Consumer Code, in particular, Chapter I, “Consumer rights in contracts,” concerning distance contracts) and Legislative Decree No. 70 of April 9, 2003, on certain aspects concerning electronic commerce.

Unless the applicable legislation provides for a different exclusive jurisdiction, all disputes arising from the interpretation or execution of the general terms and conditions of sale and contracts entered into in accordance with them shall be referred to the exclusive jurisdiction of the Court of Lecce, with the parties expressly waiving any other concurrent and/or alternative jurisdiction.


10. Amendments

These General Terms and Conditions of Sale may be amended due to new laws and regulations or other reasons.

The new General Terms and Conditions of Sale, as amended, shall be effective from the date of publication on the Website.


11. Service Suspension, Errors, and Liability

The Seller reserves the right to temporarily suspend, without prior notice, access to the Website and related services for the time strictly necessary to carry out technical interventions deemed appropriate to improve its quality. The Seller may also interrupt the provision of the service at any time if interventions are necessary for security reasons or in the event of breaches of confidentiality.

The Seller does not guarantee that the Site will operate continuously, without interruptions or errors, nor that it will be immune from malfunctions due to the Internet connection. While committed to ensuring access as regular as possible, the dynamic nature of the Internet and its content may result in suspensions, interruptions, or moments of discontinuity related to updates to the Site.

The Website does not provide any representations or warranties other than those set out in these General Terms and Conditions. The Customer uses the Website under their own responsibility and undertakes to comply with all instructions communicated by the Seller.

The Seller does not guarantee the absolute accuracy of the content on the Website. Information relating to the Products is updated regularly, but the possibility of errors cannot be excluded. The Seller reserves the right to correct any errors, inaccuracies, or omissions even after an order has been placed, as well as to modify or update the information at any time and without notice, in compliance with the Customer's rights under these General Terms and Conditions and the Consumer Code.


12. Policies

By purchasing on the Site, the customer accepts the data and cookie policies.


13. Handcrafted Products

All products are handmade. Images on the Site are indicative; actual products may differ in color, size, or details due to artisanal production.
